Application Form for the H-2B Visa

 Legal Notice:

In considering employment in the United States under the H-2b work visa program, you should be aware of the following important issues:

Government Approval Required:

Only the United States government has the authority to approve work visas for foreigners. And under law, your resort cannot employ any worker unless they can provide evidence of work eligibility in the United States.

Misrepresentation:

We will be filing immigration documents with the government based on the information you provide in the On-Line Application. If you make any false or misleading statements you can be denied future immigration benefits by the government.

Weather Risk:

The hospitality industry is weather dependent. If we experience bad weather or huricanes, the hotel or resort may be unable to provide you with the number of hours you expect.

Changing Procedures At The U.S. Consulates:

Due to increased security concerns at all United States Embassies/Consulates, policies for the issuance of all work visas are subject to regular change. While we will attempt to provide you with updates, we urge you to also regularly check with that U.S Embassy/Consulate where you intend to apply for H-2b visa issuance. Please also know that BCIS approval is conditional and does not necessarily guarantee that your local consulate or embassy will issue a visa.

Timing of Visa Issuance:

While we will make every reasonable effort to process your visa application to ensure meeting the intended start date, please know that final petition approval and visa issuance is exclusively in the control of the government. You should therefore carefully weigh the financial consequences to you that may result from visa delays and plan accordingly.

Travel Plans:

In making travel arrangements to enter the United States for employment with your hotel/resort under the H-2b visa program, you should understand that there does exist the possibility that H-2b visa issuance maybe delayed. We strongly recommend, therefore, that you do not make any travel reservations that are non-refundable.

Employment At Will:

You understand that employment at your resort is at will, which means that either the employee or the Company can terminate the employment relationship at any time, for any reason not prohibited by statute. All employment is continued on that basis. You also understand that no supervisor or manager has authority to alter the foregoing employment relationship.
